Terms and Conditions
1. Scope of Application
These Terms and Conditions apply to all orders placed through the online shop of TSWC AG, Grafenaustrasse 7, 6300 Zug, Switzerland (hereinafter referred to as "we" or "TSWC").
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. A contract is only concluded upon confirmation of the order via email.
3. Prices and Shipping Costs
All prices are in Swiss Francs (CHF) and include VAT (if applicable).
Shipping costs are listed separately and vary depending on the delivery country. Customs duties and taxes for deliveries outside Switzerland must be borne by the customer.
4. Delivery
- Delivery is made via Swiss Post or UPS.
- Delivery times vary depending on the shipping address and are shown during the checkout process.
- Partial deliveries are permitted if reasonable for the customer.
5. Payment
Available payment methods:
- TWINT
- PayPal
- Klarna (Invoice, Sofort, Installments – depending on availability)
Charges are made immediately after order completion.
6. Retention of Ownership
Goods remain our property until full payment has been received.
7. Right of Withdrawal / Returns
Customers in Switzerland: Returns are accepted within 14 days of receipt, provided the items are unworn, undamaged, and returned in original packaging.
Customers in the EU: The statutory 14-day right of withdrawal applies.
Exceptions to the right of withdrawal:
- Worn or damaged watches
- Custom-made or personalized products
8. Warranty and Guarantee
The legal warranty under Swiss law or the applicable law of the destination country applies.
In addition, we provide a manufacturer’s guarantee of 2 years on our watches from the date of purchase.
The guarantee excludes damages caused by improper use, wear and tear, or third-party interference.
9. Liability
We are liable without limitation for intent and gross negligence.
In cases of slight negligence, we are only liable for damages resulting from injury to life, body, or health, or for breaches of essential contractual obligations (cardinal duties).
10. Data Protection
Personal data is processed in accordance with our Privacy Policy.
11. Copyright
All content, images, and texts on our website are protected by copyright. Any use without express permission is prohibited.
12. Applicable Law and Jurisdiction
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction is Zug, Switzerland.
